Opus Art Supplies Referral Program Terms and Conditions
Opus Art Supplies ("Opus", "we", "us", or "our") offers you the opportunity to participate in our Referral Program (the "Program"). By participating in the Program, you (the "Referrer") agree to abide by these Referral Program Terms and Conditions (the "Referral Terms"). Opus reserves the right to update or modify the Referral Terms at any time, and your continued participation in the Program constitutes your acceptance of any such changes. Any changes will be posted on our website.
1. How the Program Works
Qualified Referral: A Qualified Referral is defined as a first-time purchase made by a Referred Customer (as defined below) who accesses the Opus Art Supplies website via the Referrer’s unique referral link or uses the referral code provided by the Referrer. The Referred Customer must make a first purchase of $50 or more, exclusive of taxes, shipping, and discounts, either in-store or online. Only one Qualified Referral is permitted per Referred Customer.
Referred Customer: A Referred Customer is an individual who:
- Has not previously purchased any products from Opus Art Supplies; and
- Is not the same individual as the Referrer (e.g., by using a different email address).
Referral Rewards: Upon a Qualified Referral, the Referrer will receive a $5 discount on their next purchase of $50 or more. The Referred Customer will receive $5 off their first purchase of $50 or more. Discounts apply to product purchases before taxes and shipping and cannot be combined with other offers, discounts, or promotions. Referral codes are valid for three (3) months from issuance.
Opus reserves the right to modify the value or terms of the Referral Rewards at any time.
Reward Limitations: The Referrer may receive one reward per Qualified Referral and may refer multiple friends. However, the total number of referrals per Referrer is limited to 20 per calendar year. Rewards are not transferable, and no substitutions or cash equivalents will be provided. Rewards may only be redeemed within three (3) months of issuance.
2. Eligibility
To be eligible to participate in the Program, you must:
- Be of legal age in your jurisdiction (e.g., 18 years or older);
- Be a legal resident of Canada;
- Only refer individuals who are new customers to Opus Art Supplies; and
- Use the Program solely for personal, non-commercial purposes.
The Referrer and Referred Customer must be two separate natural persons. Self-referrals are not permitted. For example, the Referrer cannot create multiple email addresses or accounts to generate additional referral rewards.
Opus reserves the right to restrict or suspend any individual's participation in the Program if it violates applicable laws or these Referral Terms.
3. Prohibited Conduct
In connection with your participation in the Program, you must comply with all applicable laws and regulations, including anti-spam laws. You are strictly prohibited from:
- Distributing referral links to strangers or publicly on coupon websites, blogs, or social media groups with more than 10 members;
- Using bots, scripts, or automated systems to distribute your referral link;
- Paying for advertisements that include your referral link;
- Creating multiple accounts or using alternate email addresses to refer yourself or the same person multiple times; and
- Engaging in any fraudulent, disruptive, or improper activities, as determined by Opus in its sole discretion.
Referrers are prohibited from violating any intellectual property rights of Opus or acting in any manner that is inconsistent with the intended purpose of the Program.
4. Restrictions on Rewards and Offers
For Referrers:
- Referral Rewards are issued solely as discount codes applicable to future purchases and are non-transferable, non-exchangeable, and not redeemable for cash.
- Rewards will only be issued once the Referred Customer completes their first Qualifying Purchase and no refunds or returns have been processed.
- Opus may delay the issuance of Referral Rewards pending verification of the Qualified Referral.
- Any rewards issued will be revoked if the Referred Customer requests a refund or return for the Qualifying Purchase.
- Referrers are responsible for any tax liability related to their receipt of Referral Rewards.
For Referred Customers:
- Referral Rewards may only be used on the Referred Customer's first purchase of $50 or more, either in-store or online.
- Only one referral code may be used per order.
- The referral discount may not be combined with other promotional offers or incentives.
5. Privacy
Participation in the Program may require you to submit personal information about yourself and the Referred Customer. The personal information collected will be used to:
- Administer the Program;
- Provide Referral Rewards;
- Communicate with participants; and
- Monitor compliance with these Referral Terms.
Your personal information will be processed in accordance with Opus' Privacy Policy, available on our website.
6. Limitation of Liability
To the fullest extent permitted by law, Opus shall not be liable for any direct, indirect, incidental, or consequential damages arising out of or in connection with your participation in the Program, including any loss of opportunity or loss of profit, whether based on contract, tort, or any other legal theory.
Opus' total liability for any claim arising out of or related to the Program shall not exceed the total value of Referral Rewards earned by the Referrer at the time of the claim.
7. Indemnification
By participating in the Program, you agree to indemnify, defend, and hold harmless Opus, its directors, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your participation in the Program;
- Any breach of these Referral Terms; or
- Any violation of applicable laws.
8. Right to Cancel, Modify, or Terminate
Opus reserves the right to cancel, modify, or terminate the Program at any time, for any reason, and without prior notice. Opus further reserves the right to disqualify any individual from participation in the Program if it believes, in its sole discretion, that the individual has violated these Referral Terms.
9. Miscellaneous
If any provision of these Referral Terms is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall remain in full force and effect. These Referral Terms constitute the entire agreement between you and Opus regarding your participation in the Program.
10. Governing Law
These Referral Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada. Any disputes arising out of or related to the Program shall be subject to the exclusive jurisdiction of the courts of British Columbia.
By participating in the Opus Art Supplies Referral Program, you acknowledge that you have read, understood, and agree to these Referral Terms.
